description This article aims to analyze the Peruvian Education System's response to ensure people's right to education in the framework of the emergency caused by COVID-19 and the consequences generated. Within the qualitative approach, qualitative document analysis (QDA) and thematic analysis were used as part of the analysis strategy. The sample included 16 official documents issued by the government on education policy during the pandemic. The results show that the educational system responded to the emergency with a set of policies and strategies of a reactive and provisional nature aimed at guaranteeing the continuity of the service, mainly through distance education. In addition, the government measures contemplated the pedagogical and curricular aspects for the emergency, as well as those of technological and teaching management; however, without a plan that considers the real connectivity conditions of the student population. The discussion of the findings shows that the State faced the challenge of the lack of equipment and connectivity of teachers and students, especially of vulnerable populations and rural areas, which added to the extension of the pandemic; this aggravated inequality in access to educational services, which violates the basic criterion of the right to education.

Dentro del enfoque cualitativo, se utilizó la técnica del análisis cualitativo de documentos (QDA) y el análisis temático como estrategia de análisis. La muestra incluyó 16 documentos oficiales que emitió el gobierno en materia de política educativa durante la pandemia. Los resultados muestran que el sistema educativo respondió a la emergencia con un conjunto de políticas y estrategias de carácter reactivo y provisional, orientadas a garantizar la continuidad del servicio educativo, principalmente a través de la educación a distancia. Además, las medidas del gobierno contemplaron los aspectos pedagógicos y curriculares para la emergencia, así como los tecnológicos y de gestión docente; aunque, sin un plan que considere las condiciones reales de conectividad de la población estudiantil. La discusión de los hallazgos muestra que el Estado se enfrentó al desafío de la falta de equipamiento y de conectividad de los docentes y estudiantes, especialmente de poblaciones vulnerables y de zonas rurales, sumado a la prolongación de la pandemia. Ello agravó la desigualdad en el acceso al servicio educativo, lo que constituye la vulneración del criterio básico del derecho a la educación.Este artigo tem como objetivo analisar a resposta do sistema educativo peruano para garantir o direito à educação das pessoas no âmbito da emergência pela COVID-19, e as consequências que foram geradas. Na abordagem qualitativa, utilizou-se a técnica de análise qualitativa documental (QDA) e da análise temática. A amostra incluiu 16 documentos oficiais emitidos pelo governo sobre política educacional durante a pandemia. Os resultados demonstram que o sistema educacional respondeu à emergência com um conjunto de políticas e estratégias de caráter reativo e provisório, orientadas a garantir a continuidade do atendimento educacional, principalmente através da educação a distância. Além disso, as medidas governamentais contemplaram os aspectos pedagógicos e curriculares para a emergência; assim como os tecnológicos e de gestão docente, embora sem um planejamento que considere as reais condições de conectividade da população estudantil. A discussão dos resultados mostra que o Estado enfrentou o desafio da falta de equipamentos e conectividade dos professores e alunos, principalmente de populações vulneráveis ​​e áreas rurais, somado ao prolongamento da pandemia.
