description This scientific article, entitled “Children’s right to be heard in family mediation: What? How? Why?”, aimed to analyze, from a doctrinal and legal perspective, children’s right to be heard through the family mediation process in Mexico in order to identify areas for improvement. A qualitative, cross-sectional, descriptive, and propositional approach was used. The problem identified was the existence of inconsistencies and shortcomings in the regulations that restrict the right of children and adolescents to participate in mediation sessions, a situation that violates Articles 3, 5, and 12 of the Convention on the Rights of the Child. The results showed that family mediation impacts the exercise of children’s rights, particularly the right to be heard, although there is limited information available on this topic. In conclusion, it was found that the practice of family mediation should be prioritized as it is a method that guarantees children’s rights when conflict arises.

In conclusion, it was found that the practice of family mediation should be prioritized as it is a method that guarantees children’s rights when conflict arises.El presente artículo científico, titulado: “Derecho de la niñez a ser escuchada en mediación familiar: ¿Qué? ¿Cómo? ¿Para qué?”, tuvo como objetivo analizar, desde la perspectiva doctrinal y legal, el derecho de la niñez a ser escuchada a través del proceso de mediación familiar en México para que sean identificadas áreas de oportunidad susceptibles de perfeccionamiento. Se siguió un enfoque cualitativo de tipo transversal, descriptivo y propositivo. Como problemática, se identificó que existen incongruencias e insuficiencias normativas que coartan el derecho de niñas, niños y adolescentes a participar en las sesiones de mediación, cuestión que lacera lo previsto en los artículos 3, 5 y 12 de la Convención sobre los Derechos del Niño. En cuanto a resultados, se obtuvo que la mediación familiar impacta en el ejercicio de los derechos de la niñez, en particular del derecho a ser escuchada, aunque existe escasa información al respecto. Como conclusión, se evidenció que debe priorizarse la práctica de la mediación familiar por ser un método garante de los derechos de la niñez cuando existe un conflicto.Este artigo científico, intitulado “O Direito da Criança de Ser Ouvida na Mediação Familiar: O quê? Como? Por quê?”, teve como objetivo analisar, sob uma perspectiva doutrinária e jurídica, o direito da criança de ser ouvida por meio do processo de mediação familiar no México, a fim de identificar áreas para melhoria. Utilizou-se uma abordagem qualitativa, transversal, descritiva e proposicional. O problema identificado foi a existência de inconsistências e lacunas na legislação que restringem o direito de crianças e adolescentes de participarem de sessões de mediação, situação que viola os artigos 3, 5 e 12 da Convenção sobre os Direitos da Criança. Os resultados mostraram que a mediação familiar impacta o exercício dos direitos da criança, particularmente o direito de ser ouvida, embora haja pouca informação disponível sobre o tema. Em conclusão, constatou-se que a prática da mediação familiar deve ser priorizada, por ser um método que garante os direitos da criança em situações de conflito.Universidad de Montevideo.
