| Summary: | This paper addresses the issue of digital evidence in the Uruguayan judicial process, where the General Code of Process (CGP) lacks specific regulation for this type of evidence. Currently, legal practitioners rely on the analogical application of rules designed for traditional evidentiary means, such as documentary evidence. This research questions whether this solution is adequate or if, conversely, the specificities of the digital environment require an autonomous regulatory framework. Through an analysis that integrates epistemic dimensions and ideological dimensions and by evaluating consistency with the Uruguay Digital Agenda , it is concluded that current normative frameworks are insufficient. The study argues that analogical application does not adequately guarantee epistemic quality or the protection of rights, advocating for the design of an autonomous and specific regulation that contemplates the sui generis nature of digital evidence. |
