On the other hand, the professional responsibility of physicians is often considered subjective, but coexists with legislation consumers defense which prescribes that ‘health services’ responsibility is objective.The set is so complex, so what is good to reflect on whether the socket of the responsibilityof the drugs into the defective products is the more correct all analyzing if the differentelements of this responsibility fit properly. |

El medicamento es un tipo de producto de consumo muy especial si lo comparamos con el resto de productos: no es lo mismo tomar un medicamento que tomar un refresco. No solo es especial en sí, sino que también es diferente el tipo de relación en la que se produce —en la mayoría de los casos— el consumo del medicamento: dentro de una relación sanitariaentre un médico y un paciente. Por un lado, la responsabilidad civil en el caso de los medicamentos encuentra su marco jurídico dentro de la normativa general de responsabilidadpor productos defectuosos, lo que supone una responsabilidad objetiva muy rigurosa. Por otro, la responsabilidad profesional de los médicos suele considerarse subjetiva, pero convive con la legislación defensa de consumidores que prescribe que la responsabilidad de los «servicios sanitarios» es objetiva.
