In the absence of statutory law drawn up in said respect, the Court bases its rulings on the opinion of MARIENHOFF. MARIENHOFF’s opinion on the subject matter is not at all isolated; many an author support the legitimacy presumption. However, they do so by means of dogmatic statements, lacking any deep delving in the matter, and many times – as it happens in Argentina and Spain – within a statutory framework which imposes the legitimacy presumption. A profound analysis revealsthat the legitimacy presumption is bereft of legal grounds, violates clear general principles of our law, is innecessary for the purposes of drawing the consequences intended and it is harmful, since it favors administrative arbitrations to the detriment of human rights. In sum, the legality presumption is an unnecessary and pernicious myth.

Una larga y constante jurisprudencia del Tribunal de lo Contencioso Administrativoafirma el principio de presunción de legitimidad del acto administrativo. Ante la ausencia de un texto de derecho positivo que consagre tal presunción, el Tribunal se funda en la opinión de MARIENHOFF. La opinión de MARIENHOFF sobre el punto no es por cierto aislada; son muchos los autores que sostienen la presunción de legitimidad; pero en general lo hacen mediante afirmaciones dogmáticas, sin profundizar el tema y, muchas veces —como ocurre en Argentina y España—, en un marco de derecho positivo que impone la presunción de legitimidad. Un examen a fondo de la cuestión revela que la presunción de legitimidad carece de fundamento jurídico, viola claros principios generales de nuestro derecho, es innecesaria a los efectos de extraer las consecuencias que de ella se pretende derivar y es perjudicial, puesto que favorece la arbitrariedad administrativa en detrimento de los derechos humanos.
