Summary:The ITLOS was established according to the United Nations Convention of the Law of Sea, 1982. This Tribunal not belong to United Nations system, is for that it can be called “a jurisdictional tribunal”. ITLOS starts its functions in 1996, is situated in the Hanseatic and Free City of Hamburg, Germany. Its existence provides the States parts of the Convention a pacific controversies solution mechanism. Briefly, the importance point of ITLOS is that nowadays there is a specific international tribunal on maritime affairs, whose competence is not only open to States, even International Organizations, juridical and human persons under some circumstances. A part from that the ICJ´s competence (International court of Justice) “could be modified” by this tribunal of sea. A main detail if we consider in a concerning case lead by ICJ, a State can oppose to his competence when the “ratione materiae” of it involves a maritime affair or something concerning on the Convention (interpretation or application).
