| Ամփոփում: | In this paper, we analyze third party funding in international arbitration. Even though its regulation is scarce, third party funding is a well established practice and is generally accepted by arbitral tribunals. But its existence can result in a series of issues that arbitrators must solve. Thus, the presence of a funder may result in conflicts of interest; in the submission of abusive or speculative claims; or in the frustration of the execution of an adverse award on costs. After giving a general concept of third party funding and describing how it works, we analyze how arbitral tribunals faced these issues. In particular, we analyze the different duties of disclosure imposed on parties and the weight given to the existence of third party unding when granting security for costs. |
