Tóm tắt:The article analyzes the situation of companion animals in the context of family crises and successions in Uruguayan law. It highlights the increasing importance of animals in people's lives and the need for family law to consider them when resolving conflicts. Although the Civil Code classifies them as property, they are sentient beings, and their well-being must be protected. The article proposes the analogous application of the legal provisions that protect children and adolescents in divorce cases to establish custody, visitation, and support arrangements for companion animals. It also explores the provisions to protect animals in the event of their owner’s death, together with the possibility of including them in wills and trusts. It concludes with the need for legislative reform to update the Civil Code and ensure the protection of companion animals in these situations.
