Controlling the fulfillment of the validity conditions of the arbitral agreement, especially the consent, is basic, as well as determining the possible margin of flexibility regarding those conditions, within the legal frame in force. The particularities raised by the arbitration clause included in general conditions, adhesion contracts, contract forms and other similar types are also studied. The Uruguayan state’s jurisprudence regarding arbitration, referred to the validity or not of the arbitral agreement or the arbitral award is also analyzed. |

El arbitraje comercial internacional es reconocido y regulado en nuestro ordenamiento jurídico desde hace más de un siglo. Si bien este mecanismo alternativo de solución de controversias encuentra su base en la autonomía de la voluntad, ello no plantea contradicción alguna con las normas del ordenamiento jurídico uruguayo restrictivas de esta. Resulta fundamental el control de cumplimiento de las condiciones de validez del acuerdo arbitral, en especial el consentimiento, así como la determinación de hasta dónde es posible flexibilizar dichos requisitos dentro del marco normativo vigente. Asimismo, se estudian las particularidades que plantea la cláusula arbitral inserta en las condiciones generales, en los contratos de adhesión, contratos tipo y demás modalidades afines. Se analiza también la jurisprudencia estatal uruguaya en materia arbitral, referida a la validez o no del acuerdo arbitral y del laudo arbitral.
