description This research studies the main characteristics of the environment and environmental law; its conceptualization, principles, instruments and institutional framework in Uruguay. Likewise, it seeks to determine the relationship between the phenomenon of the environment and environmental law with two sectors of legal knowledge: human rights and procedural law. Regarding human rights, it is concluded that there is a human right to a healthy environment, established legally and constitutionally, as well as in various international instruments to which Uruguay is a party. The link with procedural law is present when it becomes necessary to defend this human right to a healthy environment before the courts, from the perspective of diffuse or collective interests, and even of individual interests. It is therefore useful to have an adequate profile of the judge called to rule on this type of matters, trained to adopt, with knowledge of the subject, the necessary preventive protection measures and to decide accordingly.The study of the most important national court decisions on this subject and of some noteworthy foreign cases is also carried out.

Asimismo, se busca determinar la relación existente entre el fenómeno del medio ambiente y el derecho ambiental con dos sectores del conocimiento jurídico: los derechos humanos y el derecho procesal.En cuanto a los derechos humanos, se concluye en la existencia de un derecho humano a un medio ambiente saludable, consagrado legal y constitucionalmente, así como en distintos instrumentos internacionales de los que el Uruguay es parte. La vinculación con el derecho procesal, se hace presente cuando se torna necesaria la defensa de este derecho humano a un medio ambiente saludable, ante los estrados judiciales, desde la perspectiva de los intereses difusos o colectivos; y aún individuales. Resulta entonces útil un perfil adecuado del juez llamado a fallar en este tipo de asuntos, capacitado para adoptar, con conocimiento del tema, las medidas de tutela preventiva necesarias y fallar en consecuencia. Incluye el estudio de la jurisprudencia nacional más relevante sobre esta temática y de algunos casos importantes del derecho comparado.Na presente pesquisa estudam-se as principais características do meio ambiente e do direito ambiental; sua conceituação, princípios, instrumentos e institucionalidade no Uruguai. Além disso, busca-se determinar a relação entre o fenômeno do meio ambiente e o direito ambiental com dois setores do conhecimento jurídico: os direitos humanos e o direito processual.Quanto aos direitos humanos, conclui-se na existência de um direito humano a um ambiente saudável, consagrado legal e constitucionalmente, bem como em diversos instrumentos internacionais de que o Uruguai é parte. A vinculação com o direito processual se faz presente quando se torna necessária a defesa deste direito humano a um meio ambiente saudável, diante dos tribunais, desde a perspectiva dos interesses difusos ou coletivos; e ainda individuais. Portanto, é útil ter um perfil adequado do juiz chamado a decidir sobre este tipo de matéria, capaz de adotar, com conhecimento do assunto, as medidas de proteção preventiva necessárias e decidir em conformidade.Realiza-se também o estudo da jurisprudência nacional mais relevante sobre o tema e de alguns casos importantes de direito comparado.Universidad de Montevideo.
