The determination of trademark damages is usually one of the most complex obstacles to be overcome by trademark owners when initiating a claim for damages to those who used their trademark without authorization. The complexity of the subject and the jurisprudential doubts in the matter has led to an unnecessary saturation of the criminal system. This is why, at both the comparative and national levels, specific criteria have been established that can be used to determine trademark damage, depending on the assumptions in which we find ourselves. In the study of the local cases we have found four different classes of trademark infringements: 1. Sale of counterfeit that confused products with the original products: 2. Sale of counterfeit products that do not cause confusion with the original products; 3. Use of a trademark without authorization of the owner, in order to identify a product or service to be commercialized, without any original product or service; 4. Use of a trademark without authorization of the holder for purposes beyond the identification of a particular product or service. In order to determine the damage in each of the aforementioned hypotheses, it is necessary to use the different existing tools so far, such as property damage, extra-patrimonial damage and loss of income through a novel concept for us that is called "license hypothetical".

In order to determine the damage in each of the aforementioned hypotheses, it is necessary to use the different existing tools so far, such as property damage, extra-patrimonial damage and loss of income through a novel concept for us that is called "license hypothetical". El objetivo del presente trabajo es profundizar en el estudio de la determinación de los daños marcarios, estudiando nuestra legislación así como legislación comparada y las últimas sentencias relevantes en la materia, con el objetivo final de proponer un método simple que permita fijar criterios básicos para su determinación. La determinación de los daños marcarios suele ser uno de los obstáculos más complejos de sortear por parte de los titulares de marcas a la hora de iniciar un reclamo de daños y perjuicios a quien utilizó su marca sin autorización. La complejidad del tema y las dudas jurisprudenciales en la materia ha llevado a una innecesaria saturación del sistema penal. En el estudio de la casuística local hemos encontrado cuatro clases diferentes de infracciones marcarias: 1. Venta de productos falsificados y confundibles con los productos originales: 2. Venta de productos falsificados pero que no provocan confusión con los productos originales; 3. Uso de marca sin autorización del titular, con el fin de identificar un producto o servicio a ser comercializado, sin que exista producto o servicio original; 4. Uso de marca sin autorización del titular con fines ajenos a la identificación de un determinado producto o servicio. Para determinar el daño en cada una de las hipótesis mencionadas se debe utilizar las distintas herramientas existentes hasta el momento tales como el daño patrimonial, el daño extra-patrimonial y el lucro cesante a través de un concepto novedosos para nuestro medio que se denomina “licencia hipotética”.Universidad de Montevideo.
