description The regulation of international private situations involves the determination of three empirical aspects. The substantive law applicable to the case, the courts that will have jurisdiction and the rules of legal continuity of judgments and arbitral awards, as well as the various mechanisms of international civil for criminal procedural cooperation. In this paper we will analyze the new bases of international jurisdiction determined in Law No. 19.920, as they represented a substantive transformation of the international legal landscape. The repeal of the Appendix to the Civil Code, especially article 2401 (which contained two criteria of bilateral jurisdiction), brought with it almost twenty criteria of direct jurisdiction, where party autonomy and forum of necessity stand out, among many other parameters without direct antecedents in the pre-existing Private International Law system of conventional and autonomous source. In this paper we address the new bases of jurisdiction and the limits provided in the light of General International Law.

El derecho sustantivo aplicable al caso, los tribunales que asumirán competencia y las reglas de continuidad jurídica de los fallos y laudos arbitrales, así como los diversos mecanismos de cooperación procesal civil o penal internacional. En este artículo analizaremos las nuevas bases de competencia internacional determinadas en la ley 19.920, en tanto que representaron una transformación sustantiva del panorama iusprivatista internacional. La derogación del Apéndice del Código Civil, en especial el art.2401 (que contenía dos criterios de jurisdicción bilateral), trajo consigo casi una veintena de criterios de base de jurisdicción directa, entre los que destacan la autonomía de la voluntad, el foro de necesidad, entre muchos otros parámetros sin antecedentes directos en el sistema de Derecho Internacional Privado de fuente convencional y autónomo preexistente. En este artículo abordamos las nuevas bases de competencia y los límites que se disponen a la luz del Derecho Internacional General.A regulação de situações privadas internacionais implica a determinação de três pressupostos empíricos. O direito substantivo aplicável ao caso, os tribunais que têm competência e as regras de continuidade jurídica das decisões e sentenças arbitrais, bem como os diversos mecanismos de cooperação processual civil ou penal internacional. Neste artigo analisaremos as novas bases de competência internacional determinadas na lei 19.920, enquanto que representaram uma transformação substantiva do panorama iusprivatista internacional. A revogação do Apêndice do Código Civil, em especial o art.2401 (que continha dois critérios de jurisdição bilateral), trouxe consigo quase vinte critérios de base de jurisdição direta, entre os quais se destacam a autonomia da vontade, o foro de necessidade, entre muitos outros parâmetros sem antecedentes diretos no sistema de Direito Internacional Privado de fonte convencional e autônomo preexistente.
