La Convención CIADI, que le da origen y regula el funcionamiento del Centro, fue creada con el fin de proteger a los países signatarios y a sus inversores. Sin embargo, hoy en día se evidencia una debilidad en su regulación que podría poner en duda el sistema en su totalidad. Por ese motivo, resulta necesario un análisis y eventualmente una reforma de ciertas disposiciones de la Convención de modo que el sistema pueda efectivamente cumplir con su objetivo: proteger tanto a los inversores como a los países signatarios.O ICSID é uma das instituições dedicadas à resolução de disputas relativas a investimentos mais reconhecidos do mundo. A Convenção ICSID, que lhe dá origem e regula o funcionamento do Centro, foi criada para proteger os países signatários e os seus investidores.
