With the neoconstitucionalismo varied vision of the law. The perspective of the legal system from the human rights, which is now imposed in the case, since the right to effective judicial protection, leads to question all those ceremonials for the benefit of access to the process.

Eso, unido a la filosofía jurídica imperante en la época en que se implantó y a exigencias políticas propias del momento, llevó a la adopción de un estricto formalismo en lo que refiere al acceso al proceso, tanto en lo relativo a la legitimación activa, como a la exigencia del previo agotamiento de la vía administrativa, así como en cuanto a la fijación de plazos de caducidad para accionar. Con el neoconstitucionalismo varió la visión del derecho.
